1) Acceptance of Terms
By accessing the Site, registering for an event, purchasing merchandise, scanning our QR codes, or otherwise
using any Texas Arm Wranglers services (collectively, the “Services”), you agree to these Terms of Use (the
“Terms”). If you do not agree, do not use the Services.
2) Definitions
Company / We / Us / Our: Kactus King LLC DBA Texas Arm Wranglers.
User / You: Any person who accesses the Site or uses the Services.
Events: Arm-wrestling competitions, training, promotions, and related activities we organize or host.
Store: Our online merchandise storefront and related checkout pages.
Content: Any text, graphics, logos, photos, videos, audio, data, code, or other materials on the Services.
User Content: Content submitted or uploaded by Users (e.g., registrations, comments, images).
3) Eligibility & Accounts
You must be at least 18 (or the age of majority in your jurisdiction) to register for Events or make purchases.
Minors may participate only with verified parental/guardian consent where permitted. Portions of the Services
may require an account. You agree to provide accurate information and keep it current. You are responsible for all
activity under your account.
4) Permitted Use & Prohibited Conduct
You shall not scrape, copy, circumvent security, misrepresent your identity, upload malware, resell without
permission, or use the Services for unlawful purposes.
5) Event Registration, Participation & Fees
Event participation may require a non-refundable fee (e.g., a $20 participation fee). You agree to pay all listed
fees and assume all physical risks associated with arm wrestling or attendance.
6) Payments, Pricing, Refunds & Chargebacks
All payments are processed through third parties (e.g., Stripe). Unless stated otherwise, event fees are
non-refundable.
7) Online Store & Merchandise
Orders are subject to acceptance. Shipping times are estimates, and title passes upon delivery to the carrier.
8) Intellectual Property
The Services and Content are owned by Texas Arm Wranglers or its licensors. You may not use any trademarks
or materials without permission.
9) User Content & Media Rights
By submitting media or participating in events, you grant us rights to use your image and likeness for lawful
promotional and archival purposes.
10) Unsolicited Submissions
We do not accept unsolicited ideas or proposals. If sent, we owe no confidentiality or compensation.
11) Third-Party Links & Services
We are not responsible for third-party content, links, or services accessed through our platform.
12) Privacy & Data
Personal information use is governed by our Privacy Policy, incorporated by reference.
13) Disclaimers
The Services are provided ‘as is’ without warranties of any kind. We disclaim all implied warranties to the fullest
extent permitted by law.
14) Limitation of Liability
In no event shall our liability exceed the greater of $100 or the amount paid by you for the event or product within
the prior 12 months.
15) Indemnification
You agree to indemnify and hold harmless Kactus King LLC DBA Texas Arm Wranglers, its officers, and agents
from all claims or damages arising from your use of the Services.
16) Suspension & Termination
We may suspend or terminate Services for any violations of these Terms or for legal reasons.
17) Changes to the Services & Terms
We may modify these Terms at any time. Continued use after changes constitutes acceptance.
18) Governing Law; Venue
These Terms are governed by the laws of the State of Texas, with exclusive venue in Hidalgo County, Texas.
19) Notices; Electronic Communications; Signatures
By clicking ‘I agree’ or submitting your name, you consent to electronic signatures and records having full legal
effect.
20) General
If any part of these Terms is held invalid, the remainder remains in effect. Our failure to enforce a provision is not
a waiver.
